Akon Video and YouTube

The Universal Music Group has sent a takedown notice to YouTube to remove all incidents of the Akon Zen Video from Trinidad. They claim that the content of the video is copyrighted material. An image of the takedown notice is below.

A couple quick points:
-
1. As the video was taped by a fan and not Universal, how can they own the copyright?
2. Wouldn’t Zen (the nightclub) really have a say in the takedown as it was on their premises?
3. Why wouldn’t Universal send a takedown notice for other videos that promote him and the countless music videos that they actually paid to make that are on YouTube?
I think this is a case where this has received too much bad publicity across the internet and Universal is acting in a defensive manner to remove all evidence of the indecency, however as with all things on the internet it will alway be available for those willing to look a little more.
If all else fails the Zen Photos of Akon are still available.

You may still find copies of it on YouTube but not for long. They will continue to remove them based on the DMCA take down and send out emails to the unloaders.
She is only 14? I never see a 14 yr old dress like that yet. And what the hell a 14 year old doing in Zen???

The express reports she is fourteen but I have seen other sources that says she’s 15. I wonder if they (Express) actually verified her age.
Dre, I like how they left all the REAL copyright infringements up. while taking down the 48 sec video clip. Strange.
It’s more typical than strange when you think about it. The take down notice is actually baseless on their end from a legal standpoint and can the videos can be reinstated if fought for. They are in damage control mode but it (the video) can be found in countless online repositories. Chalk up another one to Web 2.0
It’s possible that Akon’s own people shot the video. At the concert he mentioned about putting the dance contest on You Tube. Also the original video was voluntarily removed from You Tube after one day - long before any “cease & desist” order.
